These Terms of Service and End User License Agreement ("Terms") govern your use of all Atlassian Confluence applications ("Apps") published by DailyMind LTD on the Atlassian Marketplace, and the websites at teamkit.dev and its subdomains ("Websites"). By installing or using any App, or by accessing our Websites, you agree to these Terms.
Subject to these Terms and your compliance with applicable Atlassian Marketplace terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for your internal business purposes within the Atlassian Platform.

The Apps are distributed through the Atlassian Marketplace. Your use is additionally governed by Atlassian's Marketplace Terms of Use. In the event of a conflict between these Terms and Atlassian's terms regarding Marketplace operations, Atlassian's terms prevail.
Billing, subscriptions, and refunds for paid Apps are processed through Atlassian and governed by Atlassian's policies.
All App data is processed and stored within the Atlassian Platform. We do not independently store, transmit, or have access to your Confluence data. For details, see our Privacy Policy.
Compliance Glossary is a terminology management and reporting tool. It does not constitute legal, regulatory, or compliance advice. It does not certify, guarantee, or validate your organization's compliance with any regulation, standard, or framework (including but not limited to 21 CFR Part 11, ALCOA+, ISO 13485, SOC 2, GDPR, or the EU AI Act). You are solely responsible for your compliance obligations.
The Apps depend on the Atlassian Platform. We do not guarantee availability, uptime, or performance beyond what Atlassian provides. We are not liable for outages, data loss, or service degradation caused by the Atlassian Platform.
We may discontinue, modify, or update any App at any time. For paid Apps, we will provide reasonable notice before discontinuation.
All intellectual property rights in the Apps (including source code, design, documentation, and branding) are owned by us or our licensors. These Terms do not grant you any rights to our trademarks, trade names, or branding.
Content you create using the Apps (glossary terms, reports, configurations) remains your property.
THE APPS AND WEBSITES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability.
Without limiting the above:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAILYMIND LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings, regardless of the cause of action or theory of liability, even if we have been advised of the possibility of such damages.
Aggregate liability cap. Our total aggregate liability to you for all claims arising from or related to the Apps or these Terms shall not exceed the greater of: (a) the total fees you paid to us through the Atlassian Marketplace for the applicable App in the twelve (12) months preceding the claim, or (b) fifty euros (EUR 50).

You agree to indemnify, defend, and hold harmless DailyMind LTD and its directors, officers, and agents from and against any third-party claims, losses, damages, and expenses (including reasonable legal fees) arising from:
We may suspend or terminate your access to any App if you breach these Terms. You may stop using the Apps at any time by uninstalling them through the Atlassian Marketplace.
Upon termination: Sections 7 (IP), 8 (Warranties), 9 (Liability), 10 (Indemnification), 13 (Governing Law), and 14 (Dispute Resolution) survive.
We may update these Terms at any time. Material changes will be posted with an updated date. Your continued use of the Apps after changes constitutes acceptance. If you do not agree with updated Terms, you must stop using the Apps.
These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict of law provisions. You submit to the exclusive jurisdiction of the courts of the Republic of Cyprus for any disputes arising from these Terms.
Before initiating legal proceedings, you agree to first contact us at legal@teamkit.dev and attempt to resolve the dispute informally for at least 30 days. If informal resolution fails, disputes shall be submitted to the courts of the Republic of Cyprus.
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
These Terms, together with our Privacy Policy and the applicable Atlassian Marketplace terms, constitute the entire agreement between you and DailyMind LTD regarding the Apps.
